Batavia takes step toward regulating kratom and hemp-based THC sales
Batavia’s Committee of the Whole voted to advance a revised ordinance that would limit the sale of kratom and hemp-derived THC products to adults 21 and over, with new rules on packaging, storage and enforcement.

Batavia’s Committee of the Whole backed a new ordinance that would place tighter controls on the sale of kratom and hemp-derived THC products within city limits.
While not yet final, the proposal is scheduled for a full City Council vote on June 2.
The move comes after an earlier proposal to ban these products outright drew pushback from business owners and residents. The revised version, developed in collaboration with local shopkeepers, focuses instead on access and safety —particularly for minors.
Here’s what the proposed rules would do:
Limit sales to adults 21 and up, aligning with laws for tobacco and cannabis.
Ban packaging that mimics candy or targets kids, and require products to be stored securely or kept behind the counter.
Allow enforcement through fines up to $750 per day, and open the door to license suspension or revocation for violations.
Apply to a range of businesses, including gas stations, vape shops, bars and shops.
The ordinance reflects a middle-ground approach, emphasizing public safety while still allowing responsible adult access.
